Splitifi Terms of Service

Review Splitifi’s legal terms and conditions for using our AI-powered divorce tools, legal technology platform, and resources. These terms apply to all Splitifi user profiles, including individuals, attorneys, judges, mediators, law firms, and forensic experts.

These Terms of Service (the “Terms” or this “Agreement”) form a legally binding contract between you (“Customer,” “you,” or “your”) and Splitifi, Inc. (“Splitifi,” “we,” “us,” or “our”).
They govern access to and use of every Splitifi‑branded website, application, plug‑in, mobile app, API, and related service (collectively, the “Service”), including—but not limited to—mysplitifi.com, splitifi.io, any white‑label deployments, the Splitifi Command platform, judicial dashboards, payments modules, and AI‑powered features.

If you do not agree to ALL of these Terms, you may not access or use the Service.

1  Eligibility & Authority

You represent that you (a) are at least 18 years old and legally competent to enter into contracts, and (b) have authority to bind the entity or organization on whose behalf you are acting. The Service is not available to users previously suspended or removed by Splitifi.

2  Account Registration & Security

  1. Registration Data. You must provide complete and accurate information when you create an account and promptly update it if it changes.

  2. Credentials. Each user receives unique credentials.
       • You must keep them confidential.
       • You must notify Splitifi immediately of any unauthorized use or security breach.

  3. Administrators. Primary Subscribers and designated Administrators control seat allocation, role permissions, and billing.

3  No Legal Advice; No Attorney‑Client Relationship

Splitifi is not a law firm and does not provide legal advice, representation, or attorney‑client services.
Information or AI output furnished by the Service is for informational purposes only and should not be relied on as a substitute for qualified legal counsel. Using the Service does not create an attorney–client relationship between you (or your clients) and Splitifi.

4  License & Acceptable Use

  1. Grant. Splitifi grants you a non‑exclusive, non‑transferable, revocable, limited right to access and use the Service for your internal business or personal divorce‑management purposes, subject to these Terms and your plan limits.

  2. Restrictions. You may not (and will not permit anyone to):
       a. copy, frame, reproduce, republish, or publicly display any part of the Service, except as expressly allowed;
       b. reverse‑engineer, decompile, disassemble, or attempt to derive source code;
       c. sell, sublicense, timeshare, or otherwise make the Service available to a third party except through authorized sharing features;
       d. upload or transmit any viruses, malware, or unsolicited bulk communications;
       e. access or search the Service by any automated means (e.g., scraping, spiders, bots) except through officially documented APIs;
       f. use the Service in violation of any law, regulation, court rule, or ethical obligation.

5  Third‑Party Services & Integrations

The Service may integrate or interoperate with third‑party products (e.g., payment processors, e‑filing providers, Plaid financial connectors, telephony or SMS gateways).
Your use of any such Third‑Party Services is governed solely by those providers’ terms; Splitifi is not responsible or liable for Third‑Party Services.

6  Beta & Pre‑Release Features

We may offer beta, preview, or evaluation features (“Beta Services”). Beta Services are provided AS IS, may be modified or discontinued at any time, and are excluded from any service‑level commitments.

7  Fees, Billing & Taxes

  1. Plans & Pricing. Current subscription tiers and à‑la‑carte fees are described in the Service or an ordering document.

  2. Payment Method. You must maintain a valid payment method. By providing it, you authorize Splitifi (and our processors) to charge all applicable fees plus taxes.

  3. Invoicing & Late Fees. Unless otherwise stated, subscriptions are billed in advance and are non‑refundable. Past‑due amounts may accrue 1.5% interest per month (or the maximum permitted by law) and may result in suspension.

  4. Taxes. You are responsible for all sales, use, VAT, GST, withholding, or similar taxes, except taxes based on Splitifi’s net income.

8  Free Trials & Promotions

If you register for a free trial, you will receive temporary access without charge until the earlier of (a) the end of the stated trial period or (b) the start of a paid subscription. At trial end, the Service may automatically downgrade, suspend, or start billing unless you cancel.

9  Cancellation & Termination

  1. By You. Administrators may cancel at any time via in‑product settings. Fees already paid are non‑refundable.

  2. By Splitifi. We may suspend or terminate access immediately if you violate these Terms, create a security emergency, or fail to pay fees. We will provide advance notice when practical.

  3. Effect of Termination. Upon termination, your right to use the Service ceases and we will delete your data after 90 days, except as legally required or agreed in an escrow addendum.

10  User Content & Data

  1. Ownership. You retain all rights to content you upload (“Customer Data”).

  2. License to Splitifi. You grant Splitifi a worldwide, non‑exclusive license to host, copy, process, transmit, and display Customer Data as necessary to provide and improve the Service, including to create de‑identified, aggregated analytics.

  3. Data Processing Addendum (DPA). Our DPA (Exhibit B) applies where data‑protection laws (e.g., GDPR, CCPA) require.

11  Security & Privacy

Splitifi follows industry‑standard security measures (ISO 27001‑aligned controls, encryption in transit and at rest, network segmentation, vulnerability management).
If we discover a Security Breach affecting Customer Data, we will notify you within 72 hours in accordance with our incident‑response policy.

12  Service Level & Support

Splitifi targets 99.9% monthly uptime (excluding scheduled maintenance).
Support hours and response times vary by plan and are described on the Splitifi Support page or your order form.

13  APIs

Use of the Splitifi API is subject to these Terms and the Splitifi API Policy. Excessive or abusive API calls may be rate‑limited or suspended.

14  Intellectual Property & Feedback

  1. Splitifi IP. Splitifi and its licensors retain all right, title, and interest in the Service, including all related IP rights.

  2. Feedback. You grant Splitifi a perpetual, irrevocable, royalty‑free license to use any suggestions or feedback you provide.

15  Export & Sanctions Compliance

You may not access or use the Service in violation of U.S. export‑control or sanctions laws. You represent that you are not located in, or a resident of, a country or region subject to comprehensive U.S. embargoes, nor are you on any U.S. government restricted‑party list.

16  Government Users

The Service and Documentation are “Commercial Computer Software” and “Commercial Computer Software Documentation” as defined in FAR 52.227‑19 and DFARS 227.7202. U.S. Government users acquire the Service only with those rights set forth herein.

17  Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” SPLITIFI DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, AND THAT THE SERVICE WILL BE ERROR‑FREE, UNINTERRUPTED, OR MEET YOUR REQUIREMENTS.

18  Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPLITIFI’S TOTAL LIABILITY FOR ALL CLAIMS IN THE AGGREGATE WILL NOT EXCEED THE FEES PAID BY YOU TO SPLITIFI DURING THE SIX (6) MONTHS PRECEDING THE CLAIM.
IN NO EVENT WILL SPLITIFI BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, GOODWILL, OR DATA).

19  Indemnification

  1. By Customer. You will defend and indemnify Splitifi from any third‑party claim arising out of (a) Customer Data, (b) your breach of these Terms, or (c) your violation of law.

  2. By Splitifi. We will defend and indemnify you against third‑party claims alleging that the Service, as provided, infringes a U.S. patent, trademark, or copyright, except to the extent the claim arises from (i) combination with non‑Splitifi products, (ii) unauthorized modifications, or (iii) use not in accordance with the Documentation.

20  Dispute Resolution; Arbitration; Class‑Action Waiver

Any dispute not informally resolved will be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules in Palm Beach County, Florida. YOU AND SPLITIFI WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

21  Force Majeure

Neither party is liable for delay or failure to perform due to causes beyond reasonable control, including natural disasters, strikes, terrorism, war, epidemics, or government actions.

22  Notices

Legal notices must be emailed to legal@mysplitifi.com and mailed to:

Notices are deemed given (a) one business day after email delivery, or (b) three business days after mailing by certified U.S. Mail.

23  Assignment

Neither party may assign this Agreement without the other party’s prior written consent, except in connection with a merger, acquisition, or sale of substantially all assets.

24  Entire Agreement; Order of Precedence

These Terms, any DPA, and an executed order form constitute the entire agreement and supersede all prior proposals. If there is a conflict, an order form prevails over these Terms, and these Terms prevail over any Customer purchase order.

25  Severability; No Waiver

If any provision is held unenforceable, the remaining provisions will remain in effect. Failure to enforce any provision is not a waiver.

26  Survival

Sections 3 (No Legal Advice) through 26 (Survival) survive termination.
