Understanding California Divorce Law
California is the largest community property state in the United States
Community Property
California is a strict community property state. All assets and debts acquired during marriage are divided equally (50/50).
Separate property includes assets owned before marriage, inheritances, and gifts received by one spouse.
Retirement accounts and pensions earned during marriage are also community property.
Mandatory 50/50 DivisionNo-Fault Divorce Only
Grounds: Irreconcilable differences. California was the first state to adopt pure no-fault divorce in 1970.
Neither spouse can be blamed for the divorce. The court will not consider marital misconduct when dividing property or awarding support.
Pure No-Fault StateChild Custody
California courts prioritize the health, safety, and welfare of children. Frequent and continuing contact with both parents is encouraged.
Joint legal custody (shared decision-making) is common. Physical custody arrangements are based on the childrens best interests.
